Introduction
Please read these Terms and Conditions (“Terms”) carefully before using the
BetterSelf.fitness mobile application (the “App”) operated by us (“Service
Provider”, “we”, “us”, or “our”).
By downloading or using the App, you agree to be bound by these Terms. If you
disagree with any part of the terms, you may not use the App.
License
Subject to your compliance with these Terms, we grant you a limited,
non-exclusive, non-transferable, revocable license to download, install, and use
the App for your personal, non-commercial use on a mobile device owned or
controlled by you.
Restrictions
You agree not to, and you will not permit others to:
- Copy, modify, translate, or create derivative works of the App.
- Attempt to extract the source code of the App.
- Remove, alter, or obscure any proprietary notices (including copyright and
trademark notices) on the App.
- Use the App for any illegal purpose or in violation of any local, state,
national, or international law.
- Use the AI Assistant to generate harmful, misleading, or inappropriate content.
- Attempt to manipulate or abuse the credit system, including through fraudulent
purchases or automated interactions.
User Accounts
To use certain features of the App, you may be required to create an account.
You agree to provide accurate, current, and complete information during the
registration process and to update such information to keep it accurate,
current, and complete. You are responsible for safeguarding your account
credential and for any activities or actions under your account.
AI Assistant
The App includes an AI-powered Assistant feature that provides personalized
fitness and nutrition guidance. By using the AI Assistant, you acknowledge and
agree to the following:
No Medical or Professional Advice
The AI Assistant is provided for informational and general wellness purposes
only. It is not a substitute for professional medical advice, diagnosis, or
treatment. The AI Assistant is not a licensed healthcare provider, dietitian,
nutritionist, or personal trainer.
- Always seek the advice of your physician or other qualified health provider
with any questions you may have regarding a medical condition, diet, or
exercise program.
- Never disregard professional medical advice or delay in seeking it because of
something the AI Assistant has told you.
- If you have injuries, medical conditions, or dietary restrictions, consult a
qualified professional before acting on any AI-generated suggestions.
Accuracy and Limitations
- The AI Assistant uses artificial intelligence technology that may produce
inaccurate, incomplete, or inappropriate responses. You should
independently verify any information provided by the AI Assistant before
relying on it.
- Calorie counts, nutrient estimates, and fitness recommendations generated by
the AI are approximate and may not be accurate. Do not rely solely on
AI-generated data for critical health decisions.
- The AI Assistant may create or update food log entries on your behalf based on
your conversations. You are responsible for reviewing and verifying the
accuracy of any entries created by the AI.
Data Usage
- When you use the AI Assistant, your user profile data, food and calorie
context, and chat messages (including attached images) are sent to third-party
AI services for processing. Please refer to our
Privacy Policy for details.
- You are responsible for the accuracy and appropriateness of the information
you provide to the AI Assistant.
User-Uploaded Content
- When you upload images (e.g., photos of meals) to the AI Assistant, you grant
us a non-exclusive, worldwide, royalty-free license to use, process, and store
those images solely for the purpose of providing the AI Assistant service.
- You must not upload images that contain illegal, explicit, harmful, or
copyrighted content that you do not have the right to share.
- We reserve the right to remove any uploaded content that violates these Terms.
Credits and In-App Purchases
Credit System
- New users receive a welcome bonus of free credits upon account creation.
- Free-tier users consume credits when interacting with the AI Assistant.
Premium subscribers have unlimited AI Assistant access and do not consume
credits.
- Credits are tracked in your account and can be viewed within the App.
Purchasing Credits
- Additional credits can be purchased through the App via in-app purchases.
Credit packs are available in various quantities.
- All purchases are processed through the platform’s app store (Google Play
Store or Apple App Store) and are subject to the respective store’s terms and
conditions.
- Purchase management and billing are handled through our third-party payment
processor.
Refund Policy
- Credit purchases are generally non-refundable once the credits have been
added to your account.
- Refund requests for unused credits may be submitted to the respective app
store in accordance with their refund policies.
- We reserve the right to issue refunds or credit adjustments at our sole
discretion.
Premium Subscriptions
- Premium subscriptions provide enhanced features including unlimited AI
Assistant access and cloud data synchronization.
- Subscription terms, pricing, and renewal details are presented at the time of
purchase and are managed through the respective app store.
- You may cancel your subscription at any time through your app store account
settings. Cancellation takes effect at the end of the current billing period.
Data Synchronization
- The App may synchronize your fitness data (such as food entries, exercise
plans, activity logs, and other user-entered data) between your device and our
cloud servers to enable backup and core functionality.
- Data synchronization requires an active internet connection and a valid user
account.
- We do not guarantee real-time synchronization or uninterrupted access to
synced data. Temporary disruptions may occur due to network conditions or
server maintenance.
- In the event of sync conflicts (e.g., edits made on multiple devices), the
most recently modified version will take precedence.
Third-Party Services
- Third-party AI service providers: Power the AI Assistant feature.
- Third-party billing providers: Manage in-app purchases and subscriptions.
- Cloud infrastructure providers: Provide backend database, authentication,
and storage services.
- Health Connect by Android: Provides health data integration. Subject to
Google’s Health Connect policies.
We are not responsible for the availability, accuracy, or reliability of these
third-party services. Any disruptions or changes to third-party services that
affect App functionality are beyond our control.
Intellectual Property
The App and its original content (excluding Content provided by users),
features, and functionality are and will remain the exclusive property of the
Service Provider and its licensors. The App is protected by copyright,
trademark, and other laws.
Disclaimer of Warranties
The App is provided to you “AS IS” and “AS AVAILABLE” and with all faults and
defects without warranty of any kind. To the maximum extent permitted under
applicable law, we expressly disclaim all warranties, whether express, implied,
statutory, or otherwise, with respect to the App, including all implied
warranties of merchantability, fitness for a particular purpose, title, and
non-infringement.
Without limiting the foregoing, we make no warranty or representation that:
- The AI Assistant will provide accurate, complete, or reliable information.
- Food log entries created by the AI will be accurate in their calorie counts,
nutrient values, or meal categorizations.
- Data synchronization will be uninterrupted, timely, or error-free.
- The App will meet your specific health or fitness goals.
Limitation of Liability
In no event shall the Service Provider be liable for any special, incidental,
indirect, or consequential damages whatsoever (including, but not limited to,
damages for loss of profits, loss of data, or other information, for business
interruption, for personal injury, loss of privacy arising out of or in any way
related to the use of or inability to use the App, the AI Assistant, or any
AI-generated content), even if the Service Provider has been advised of the
possibility of such damages.
You expressly acknowledge that the Service Provider shall not be liable for any
damages arising from your reliance on AI-generated fitness advice, nutrition
information, or food log entries.
Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms
at any time. By continuing to access or use our App after those revisions become
effective, you agree to be bound by the revised terms.
Termination
We may terminate or suspend your access immediately, without prior notice or
liability, for any reason whatsoever, including without limitation if you breach
these Terms. Upon termination:
- Your right to use the App will cease immediately.
- Your remaining credit balance will be forfeited and is non-refundable.
- Your synced data may be deleted from our servers in accordance with our
Privacy Policy.
